Visa Refusals

If you visa application has been refused, it is important to decide what course of action you need to take within the stipulated time frames. We will help you decide whether it is in your best interest to appeal the decision to refuse your visa, re-lodge a fresh visa application or whether a new application as well as an appeal made simultaneously is the best way forward.

Visa Cancellations

In most instances, prior to visa cancellation, an applicant will receive a “Notice of Intention to Consider Cancellation”. If the visa is subsequently cancelled, it is likely that other bridging visas the applicant holds will also be cancelled.

Visa Appeals

You will most likely have an opportunity to make an application to appeal a visa refusal or cancellation if the decision was made while you are onshore (inside Australia). Applications for review of a decision are typically required to be made within 7 days of a cancellation and within 21 days in the case of a visa refusal. We can lodge and manage visa appeals to the Administrative Appeals Tribunal (AAT previously MRT) for you urgently, professionally and with confidence.

The Migration & Refugee Division (MRD) of the AAT reviews most appeals lodged after visa refusal decisions. The Immigration Assessing Authority (IAA) reviews some Protection Visa decisions on the papers (without a hearing). The General Division of the AAT mostly hears and determines Character related refusals.
